This agreement is a legally binding contract between you (referred to as "the Author" or "the Client" or "the User") andZarat Digital Publishing(referred to as "Zarat" or "the House" or "the Site"). By using our services or requesting any of the publishing packages, you fully and unconditionally agree to comply with these terms.

1. Legal Authorization and Account Management

This clause is essential for enabling the House to provide its services:

By agreeing to this agreement and requesting the publishing service, you grantZarat Digital Publishingfull and direct authorization to perform the following actions on your behalf:

  1. Account Creation:Using your name and information to create and manage author/publisher accounts on global publishing platforms (including but not limited to: Amazon KDP, Draft2Digital, Smashwords, Google Play Books) and any other platforms required for publishing the work.

  2. Data Management:Creating and using a dedicated email to manage these accounts, setting necessary passwords, and handling verification codes.

  3. Approval on Your Behalf:Approving on your behalf the terms and conditions and policies of those global platforms for the purpose of completing the publishing process.

  4. Asset Delivery:The House is committed to delivering all login information (email, passwords, access links) related to your accounts immediately upon completion of the publishing process, making you the primary and sole responsible party thereafter.

2. Intellectual Property and Copyright

We respect your rights and protect ourselves from violations:

  1. Content Ownership:The author retains all intellectual, financial, and literary property rights to their book. "Zart" does not claim any permanent ownership rights over the content, and our role is limited to being a "service provider" and "technical intermediary."

  2. Declaration of originality:The author acknowledges and undertakes that the submitted content (text, images, illustrations) is the result of their own creativity, or that they hold the necessary official licenses for its use, and that it does not infringe on any intellectual property rights of third parties.

  3. Legal responsibility:The author alone bears full legal responsibility (civil and criminal) for the content of the book before official authorities and global platforms. "Zart" completely disclaims any responsibility for any stolen, plagiarized, offensive, or illegal content under local or international laws.

  4. Indemnification:The author agrees to indemnify "Zart" for any damages, losses, or legal claims that may arise as a result of their violation of intellectual property rights or violation of publishing laws.

3. Publishing and Distribution Services

How we work and what to expect from us:

  1. Acceptance and rejection:The publishing house reserves the right to refuse to publish any content it deems contrary to public morals, incites hatred, or violates the policies of global platforms, without providing reasons and without any liability.

  2. Global platforms:The publishing house seeks to publish the book on the agreed platforms, but it does not guarantee acceptance of the book by any specific platform (such as Amazon or Apple) as these platforms are subject to their own review policies beyond our control. In the case of a technical rejection, we will work to rectify it.

  3. Profits and sales:

    • In the case of the author managing their accounts:The publishing house does not charge any commission on sales (0% commission), and profits from the platforms are transferred directly to the author's bank account.

    • In the case of the publishing house managing the profits (upon special request):An agreement is made under a separate contract annex that specifies the commission rates and transfer mechanism.

  4. Modifications:The packages include a limited number of reviews and revisions before publication. Any substantial changes after publication may incur additional fees.

4. Privacy and Data Confidentiality

Your data is a trust we hold:

  1. The publishing house is committed to maintaining the confidentiality of manuscripts, files, and personal data provided by the author, and will not share them with any third party except for the purpose of completing the publishing process (such as sharing with Amazon or contracted designers).

  2. The author agrees to the use of their data (name, email, address) for the purpose of opening and documenting publishing accounts.

5. Cancellation and Refund

  1. Before starting:The author can cancel the order and receive a full refund if the team has not started working (within 24 hours of the order).

  2. During work:If work has started (cover design, formatting, editing), only a one-month postponement of publication is allowed.

  3. After publication:The amount cannot be refunded after the publication process is completed and the files are uploaded to the platforms.

6. Communication Policy, Technical Support, and Appointment Booking

In our effort to organize work and ensure the accuracy of exchanged information, the following communication policy is adopted as an integral part of this agreement:

B. Response Time Frame (SLA):

We are committed to responding to your inquiries as quickly as possible, while reserving the right to respond within a period of24 to 48 business hours.The organization is not responsible for any delays resulting from the client sending urgent requests outside official channels or during holidays, and a lack of immediate response does not constitute a service deficiency.

C. Customer Service via WhatsApp:

Instant messaging channels (such as WhatsApp) are designatedfor quick and general inquiries only.Technical notes or significant changes sent via WhatsApp are not accepted unless explicitly requested by the team. Your use of WhatsApp means you accept that the response may not be immediate and is subject to the time frame mentioned above.

D. Appointment Booking and Consultations:

Phone consultations or lengthy meetings are not provided without a prior appointment. Appointments for meetings or detailed discussions must be booked exclusively through the designated official link:

Appointment requests are subject to review and approval by our team, and the appointment will be confirmed electronically. The organization reserves the right to cancel or reschedule unconfirmed appointments.

6. General Provisions

  1. Governing Law:This agreement is subject to the laws and regulations of the Kingdom of Saudi Arabia.

  2. Amendment:"Zart" has the right to amend these terms at any time, and your continued use of the service constitutes acceptance of the amendments.

By checking the box of agreement upon completing the order, you acknowledge that you have read this agreement, understood its terms, and agree to comply with them.
